We have developed these Terms of Use and Services “(TERMS OF USE AND SERVICE”) to list the terms and conditions applicable to using the Site and the information contained on the Site.
IMPORTANT! THESE TERMS OF USE AND SERVICE GOVERN YOUR USE OF THIS SITE, WHICH IS PROVIDED BY TSC. BY ACCESSING, BROWSING OR OTHERWISE USING THIS SITE, YOU ARE INDICATING, WITHOUT LIMITATION OR QUALIFICATION, YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THESE TERMS OF USE AND SERVICE AND YOUR AGREEMENT TO ABIDE BY THEM, AND ALL APPLICABLE LAWS, RULES AND REGULATIONS, IN THEIR ENTIRETY. THESE TERMS OF USE AND SERVICE ARE SUBJECT TO CHANGE BY TSC AT ANY TIME IN TSC’S SOLE DISCRETION. YOUR USE OF THIS SITE AFTER SUCH CHANGES ARE IMPLEMENTED CONSTITUTES YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THE CHANGES MADE. PLEASE CONSULT THESE TERMS OF USE AND SERVICE REGULARLY.
General Purpose of Site. “The purpose of the Site is to provide our users with relevant information about TSC combine events, along with offering on-line registration for combine events and access to combine event results.
Age Restriction. This Site is intended for use by persons 18 years of age and older.
TSC Content. Unless otherwise stated, and/or relating to user generated content, all other images, text, audio, video, graphics or other content (including, without limitation, names, logos, trade names, trademarks, trade dress, trade secrets, copyrights, service marks, patents, and other intellectual property and proprietary material, including the Site itself) displayed or otherwise published on the Site (collectively, “TSC Content”), may only be used in the manner provided for in these TERMS OF USE AND SERVICE and is owned by TSC. TSC retains all right, title and interest in and to the respective TSC Content. Access to the Site does not transfer any right, title or interest in the Site, TSC Content or other Site content to you. You are not to remove or alter any intellectual property or other proprietary notices visible on the Site.
There may be other content on the Site not owned by TSC. The other content remains the property of the respective owner, and access to the Site does not transfer any right, title, or interest to such content to you.
TSC and the TSC logo are marks of TSC. Other marks, names, and logos on this Site are the property of their respective owners.
All rights not expressly granted are herein reserved to TSC.
Permitted Use of Site. Certain elements of the Site, including but not limited to, text, graphics, photographs, audio, video, images, and Site layout are protected by United States and international copyright laws. No portions of the Site may be copied, republished, modified, edited, transmitted, used to create derivative works of, or reverse engineered without permission.
Restrictions on Use of Site. Except as expressly provided herein, the Site content may not be used for any purpose without TSC’s express prior written consent. No third party’s content may be used for any purpose whatsoever without your first obtaining such third party’s express prior written consent. Any modification or use of the Site content except as expressly provided herein may violate TSC’s or a third party’s intellectual property rights. You agree to cooperate with TSC in causing the immediate cessation of any unauthorized modification or use of the Site or any content.
Disclaimer of Warranties. Although we have tried to provide you with an accurate, safe and up-to-date Site, we cannot be certain nor warrant that all such content is free from errors or omissions. You use of the Site is at your own risk.

Limitation on Liability. IN NO EVENT SHALL TSC, OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, REPRESENTATIVES, ATTORNEYS, OR CONTENT PROVIDERS, OR ANY OF THEIR SUCCESSORS AND ASSIGNS (“TSC PARTIES”), BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, ACTUAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER, INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, OR EMOTIONAL DISTRESS, EVEN IF TSC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, BASED ON: YOUR USE (OR INABILITY TO USE) OF THE SITE OR ANY CONTENT; ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR INACCURACIES IN THE SITE; OR ANY OTHER MATTER RELATING TO THE SITE. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF TSC AND THE TSC PARTIES EXCEED THE GREATER OF $100 OR THE AMOUNT THAT YOU HAVE PAID TO TSC FOR THE APPLICABLE CONTENT, GOOD OR SERVICE OUT OF WHICH LIABILITY AROSE (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT OR OTHERWISE).

Indemnification. This indemnification obligation shall survive the termination of these TERMS OF USE AND SERVICE.
Site Discontinuation or Modification. TSC may use any Submission in its business (including, without limitation, for products or advertising) without incurring any liability for royalties or any other consideration of any kind. TSC will not incur any liability as a result of any similarities that may appear in future TSC operations.
Unsolicited Proposals. While we welcome your comments and feedback (through e-mail, regular mail or over the telephone) with respect to the Site or our product, please note that we are not seeking any unsolicited ideas, suggestions or materials related to the development, design, manufacture or marketing of our product. If you send us any proposed ideas or other such information, you understand and agree that such proposals (i) will be treated as non-proprietary and non-confidential and (ii) may be used by TSC for any purpose whatsoever, commercial or otherwise, without any compensation to you.
Hyper-Linked Sites. As you may have noticed, we have provided some links to other sites that we thought might be of interest to you. If you use or link to these other sites, you will leave the Site. These sites may be operated by companies, persons or entities that are unrelated to TSC. TSC has not reviewed all such sites in great detail, and cannot be responsible for the content presented on those sites which are not operated by TSC. As a consequence, linking to any non-TSC website is at your own risk and you should consult the terms of use and privacy policies of those sites. TSC makes no representations or warranties about the content, completeness, or accuracy of such non-TSC websites or the hyper-links to such sites. Third Party Advertisements. TSC may also feature on the Site recipes and other information on different non-TSC products which may be provided by third parties such as our sponsors. While TSC does its best to only offer quality information, it cannot guarantee the accuracy of such information. By providing such information, TSC does not necessarily endorse it.
Online Accounts. As part of the Site experience, you will be able to create a password protected online account (“Online Account”). Through your Online Account, you will be able view your combine results and register for upcoming combine events. You agree to provide accurate information when signing up for an Online Account. You are responsible for maintaining the confidentiality of your Online Account password, and agree to notify TSC if your password is lost, stolen or disclosed to an unauthorized party. You are responsible for all activities conducted through your Online Account. Your combine event results and not private and can be viewed by other users including combine participants, parents and guardians of combine participants and coaches.
Site Visitor Conduct. As referenced above, you are able to upload/post user generated content to the Site, including the ability to post comments about another party’s user generated content. You will have the ability to upload/post user generated content on both the Site in general, as well as through your Online Account.
You agree that you, not TSC, are entirely responsible for all of your user generated content including, but limited to, information, text, comments, data, documents, images, photographs, graphics, audio, videos, or webcasts that you upload, post, email, transmit or otherwise make available (collectively, “Make Available”) through your use of the Site (such content, collectively, “Your Content”), whether publicly posted or privately transmitted. TSC does not claim ownership in Your Content. You assume all risks associated with use of Your Content, including any reliance on its accuracy, completeness or usefulness. Unless otherwise stated herein or in our Privacy Policy, all of Your Content that you Make Available to the Site will be publicly available to be viewed by other users of the Site. In no way is TSC liable for any legal claim related to Your Content, and you assume all liability associated with Your Content.

- Violate any federal, state, local or international laws or regulations;

- Access or use the Site or content in any manner that could damage, disable, overburden or impair any TSC server or the networks connected to any TSC server;
- Interfere with or disrupt the Site or content or violate any applicable laws related to the access to or use of the Site or content, violate any requirements, procedures, policies or regulations of networks connected to the Site or content, or engage in any activity prohibited by these TERMS OF USE AND SERVICE and/or the Privacy Policy;
- Disrupt or interfere with the security of, or otherwise cause harm to, the Site or any content, systems resources, accounts, passwords, servers or networks connected to or accessible through the Site or any affiliated or linked sites;
- Disrupt, interfere with, or inhibit any other Site visitor from using and enjoying the Site, content, or other affiliated or linked sites or content;
- Access or attempt to access or hack into any content or computer system or server that you are not authorized to access or through any means not intentionally made available through the Site;
- Make attempts to circumvent security features;

The previous list is not exclusive. TSC reserves the right to: (1) terminate your access to the Site for any reason; and (2) delete or edit any of Your Content (but TSC has no duty to delete or edit Your Content even if requested to do so by a third party) for any reason including but not limited to content that violates these TERMS OF USE AND SERVICE or is otherwise objectionable. TSC is under no duty to, and does not represent it will, monitor or pre-screen Your Content.
Copyright Infringement Notification. If you believe that any content on the Site infringes your copyright and you want the content removed from the Site, please send a detailed message (under the Digital Millennium Copyright Act, the following information must be included in the message) to TSC’s designated agent for notice of claims of copyright infringement:
(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works at that site.
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit TSC to locate the material.
(iv) Information reasonably sufficient to permit TSC to contact you as the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

Other Intellectual Property Infringement. If you believe that any content on the Site violates or infringes your intellectual property rights, other than copyright claims referenced in the previous section, please send a detailed email to detailing your allegation or complaint. TSC takes infringement of intellectual property rights seriously and will investigate the matter.
Cooperation with Law Enforcement. We reserve the right to cooperate and comply with all legal requirements, authorities and processes regarding your use of the Site. You waive and hold harmless TSC from any claims resulting from any actions taken by TSC in connection with TSC cooperating and complying with all legal requirements, authorities and processes regarding your use of the Site. This includes, but is not limited to, if TSC is required by law to disclose your identity and online activity.
Severability. If any provision of these TERMS OF USE AND SERVICE is held to be unlawful, void or unenforceable, that part will be deemed severable and it will not affect the validity and enforceability of any remaining provisions.
Geographic Limitation. TSC operates the Site from its headquarters in the United States. The Site is only intended for users within the United States. If you use the Site outside the United States, you are responsible for complying with your local laws.
Amendments. Please note that we reserve the right to change the content of these TERMS OF USE AND SERVICE at any time in our sole discretion and with no notice to you. Choice of Law; Venue. These TERMS OF USE AND SERVICE will be governed and interpreted pursuant to the laws of the State of Illinois without regard to any principles of conflicts of law. You specifically consent to personal jurisdiction in Lake County, Illinois in connection with any dispute between you and TSC arising out of these TERMS OF USE AND SERVICE or pertaining to the subject matter hereof. The exclusive venue for any dispute arising out of these TERMS OF USE AND SERVICE or pertaining to the subject matter hereof shall be in the state and federal courts in Pittsburgh, Pennsylvania.
Assignment. TSC may assign or transfer these TERMS OF USE AND SERVICE to any entity which is a successor to TSC’s interest, whether by merger, asset acquisition or otherwise in TSC’s sole discretion. You may not assign or transfer these TERMS OF USE AND SERVICE.
Use of Internet. TSC does not assume any liability or responsibility for your use of the Internet or the Site, including but not limited to, any effect such use may have on your computer or network.
Survival. The proprietary rights, disclaimer of warranties, representations made by you, indemnities, and limitations of liability shall survive the termination of these TERMS OF USE AND SERVICE.
Waiver. TSC’s failure to enforce any provision of these TERMS OF USE AND SERVICE does not constitute a waiver of same provision.
Termination. If you violate any provision of these TERMS OF USE AND SERVICE, TSC may deny you access to the Site and/or delete your Online Account without notice to you.
